WINTER HAVEN | A 27-year-old Winter Haven man was legally justified in shooting and killing an intruder who was breaking into his family’s home last month, the State Attorney’s Office said.
Luis Pena Jr. fired two shots toward 40-year-old Mitchell Large during the early morning hours of April 7, Winter Haven police said.
The first shot was a warning shot, and the bullet went into a wall above a set of French doors that Large was attempting to break through, according to police.
Pena fired the second shot after Large continued to break into the family’s home, police said.
Large was hit in the chest and declared dead at the scene, a police report states.
The State Attorney’s Office said Pena was justified in shooting and killing Large, and no charges will be filed against him.
Pena awoke about 6:30 a.m. to the sound of a person on the back porch of his family’s house at 4219 Lake Marianna Drive, according to Winter Haven police.
Pena walked into the kitchen and saw a man trying to open the French doors, police said. Pena ran back to his bedroom, woke up his parents and armed himself with his silver .357-caliber revolver, according to a police report.
He then went back to the kitchen and fired one warning shot into the wall above the French doors, the report states.
At that time, Pena’s parents, Vicentia and Luis, also armed themselves and went into the kitchen, police said.
The homeowners told police they yelled for Large to stop, but he continued to break through the doors and started charging toward them once inside.
Pena fired a second shot and his mother fired one shot, police said. Luis Pena’s bullet hit Large in the chest and Vicentia Pena missed, police said.
